Can you back out of a retainer agreement?

You can back out of a retainer agreement, but the exit runs through its termination clause. Most retainers allow either party to end the arrangement with written notice, commonly 30 days. Without a termination clause, you are negotiating your way out instead of following a procedure.

Whether you get money back depends on the fee type. A retainer paid against future work is usually refundable for the unused portion. A true retainer paid just to reserve availability often is not, and courts generally honor that split.

With lawyers specifically, clients can typically fire the attorney at any time and recover unearned fees. For everyone else: read the clause before signing, and never sign a retainer that has no exit at all.
